- Should I speak with the insurance company for the at-fault driver?
Only to the extent of verifying property damage so that this can be paid as soon as possible.
- Should I speak with my own insurance company following an automobile accident?
Yes. You are required to notify your insurance company and to cooperate with them.
- If the at-fault driver has insurance, will I be covered for my pain and suffering and permanent injury?
Not necessarily. The driver may have a "PIP and Property Damage Only" policy which will cover your vehicle damage, but not your bodily injury.
- Will my Personal Injury Protection (PIP) Coverage cover all my medical bills?
No. PIP covers only 80% of your medical bills. If you have elected a deductible, then none of your bills will be paid until the deductible has
been met. If you have also purchased "medical payments" coverage, then the remaining 20% of your medical bills will be paid by this.
- If I didn't cause the accident why should my insurance have to pay the medical bills?
This is Florida Law and it's meant to protect everyone so that bills are promptly paid regardless of fault. The insurance of the at-fault party
is required to pay the 20% of each medical bill that PIP does not pay.
- What do I have to do to get my medical bills and lost wages paid by my insurance company following an automobile accident?
Besides notifying your insurance company, most companies require that you complete a PIP application. All companies require that you sign a
medical authorization and an authorization for your employer.
- Will I be paid lost wages during the time I am not able to work?
If you have PIP insurance you will be paid 60% of your lost wages if you have a medical excuse.
- How long will it take my insurance company to pay my medical bills and lost wages?
If you have completed a PIP application, your insurance company has 30 days from the date of receipt of medical bills and lost wage information to
pay your medical bills and lost wages.
- If the at-fault driver has no insurance, will my own insurance company pay for my bodily injury losses?
Only if you are covered by uninsured motorist insurance.
